Terms of Service

This Agreement is a binding contract between you ("Customer," "you," or "your") and RiskAdvisor ("Provider," "we," or "us"). It governs access to and use of PolicyLink on this public host and related branded PolicyLink URLs.
This page is a PolicyLink presentation based on the RiskAdvisor Terms of Service Agreement last modified July 3, 2024. Agency subscriptions to RiskAdvisor services remain governed by that full agreement.
THE AGREEMENT TAKES EFFECT WHEN YOU ACCESS OR USE POLICYLINK (the "Effective Date"). BY ACCESSING OR USING POLICYLINK YOU (A) ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTAND THIS AGREEMENT; (B) REPRESENT THAT YOU HAVE THE RIGHT, POWER, AND AUTHORITY TO ENTER INTO THIS AGREEMENT AND, IF YOU ACT FOR AN ORGANIZATION, THAT YOU CAN BIND THAT ORGANIZATION; AND (C) ACCEPT THIS AGREEMENT AND AGREE THAT YOU ARE LEGALLY BOUND BY ITS TERMS.
IF YOU DO NOT AGREE TO THESE TERMS, YOU MAY NOT ACCESS OR USE POLICYLINK.
Who you are
If you are an insurance agency (or an Authorized User of an agency) using PolicyLink to collect current policy details, you are a Customer of the RiskAdvisor Services. PolicyLink is part of those services.
If you are a person opening a PolicyLink for an agency, you are using the public link to send information to that agency. You must only submit information you have a right to provide. The agency is responsible for how it uses your submission for quoting and servicing.
The PolicyLink service
PolicyLink provides branded, public policy-import links. Agencies share a URL; customers submit current policy details or complete an optional carrier connect; agencies receive that information to procure insurance quotes. PolicyLink is not an insurer and does not bind coverage.
Provider grants Customers a limited, revocable, non-exclusive, non-transferable right to use PolicyLink for internal business operations by Authorized Users, subject to fees and the full RiskAdvisor Terms of Service where a subscription applies.
Third-party connector terms for MeasureOne
PolicyLink may permit access to MeasureOne, a Third-Party Product, so a customer can connect a carrier account when the agency enables that option. MeasureOne is subject to its own terms and privacy policy presented in that connect flow. If you do not agree to abide by MeasureOne's terms, do not use carrier connect.
Carrier login credentials are entered with MeasureOne. Provider does not store those credentials. Retrieved policy information becomes Customer Data of the agency that published the PolicyLink and is used to procure insurance quotes.
Customer data and quotes
Information submitted through PolicyLink is Customer Data of the agency that published the link. You grant Provider the licenses needed to host, process, and transmit that data so we can provide the service. Providing the service includes sharing data with insurance vendors, carriers, MeasureOne when connect is enabled, and others in the insurance industry to obtain quotes.
Customer is solely responsible for the content of Customer Data and for having consent from the person or entity for whom a quote is obtained.
Use restrictions
You shall not copy, modify, or create derivative works of PolicyLink; rent, sell, or sublicense it except as permitted; reverse engineer its software; remove proprietary notices; or use it in a way that infringes rights or violates Applicable Laws. Use is limited to the United States and its territories as described in the full RiskAdvisor agreement.
Acceptable use and privacy
PolicyLink may be used solely to procure insurance quotes from insurance carriers, and only with the consent of the person or entity for whom the quote is obtained. You must also follow our Acceptable Use policy and Privacy Policy.
Service quality and disclaimers
Provider uses commercially reasonable efforts to make PolicyLink available during normal business hours. PolicyLink is provided "AS IS". Provider disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Provider does not warrant that PolicyLink will be uninterrupted, error-free, or free of harmful code.
Limitation of liability
To the fullest extent permitted by law, Provider is not liable for consequential, incidental, indirect, special, or punitive damages; lost profits or goodwill; or loss or recovery of data, including from a security incident. Provider's aggregate liability related to this Agreement will not exceed the amounts paid to Provider for the RiskAdvisor Services in the twelve month period before the claim.
Governing law
This agreement is governed by the internal laws of the State of South Carolina, without regard to conflict of law rules. Legal proceedings related to this agreement will be brought in the federal courts of the United States or the courts of the State of South Carolina located in Richland County, South Carolina.
Changes
We may modify this Agreement by posting updates on this page or on https://riskadvisor.insure. Continued use of PolicyLink after the effective date of a modification is acceptance of the modified terms.
